A 48-year-old Vero Beach man died on the night of August 9 after a pickup struck his e-bike on Eighth Street and drove off. Deputies closed the road for six hours while troopers worked the scene, and the driver was not identified that night. For the rider’s family, the days before an arrest raise their own set of legal questions.
How the Crash Happened
The rider was traveling west on Eighth Street in Vero Beach South shortly before 9 p.m. with a Ford F-150 directly behind him. According to Vero News, the driver steered to the southwest and crossed partly into the eastbound lane in an attempt to pass, and the right side of the truck struck the rider and knocked him to the pavement. The truck continued west. The rider was taken to a Fort Pierce hospital, where he was pronounced dead.
Troopers described the pickup as a light-colored F-150 built between 2015 and 2020 with its right-side mirror missing. An Indian River County Sheriff’s Office spokesperson confirmed the truck was last seen heading west on Eighth Street.
Why a Missing Mirror Matters
A broken mirror left at the scene gives investigators a part number, a model year range, and a physical match once a suspect vehicle turns up. In a civil claim, that same evidence places the truck at the point of impact. Physical evidence of this kind often decides a hit and run case before the driver ever gives a statement.
The Claim Does Not Wait for an Arrest
A Vero Beach, FL bicycle accident lawyer can begin building the wrongful death claim while the driver remains unknown. The crash report, the 911 recording, nearby camera footage, and witness contact information all exist within days of the crash, and some of it disappears within weeks. Private surveillance systems overwrite footage on a schedule. A preservation letter sent early keeps that footage available.
The two-year filing deadline for a wrongful death claim under Florida Statute 95.11 runs from the date of death, not from the date of an arrest.
Where Compensation Comes From
When no driver has been identified, the first source of recovery is often the rider’s own auto policy. Uninsured motorist coverage treats a hit and run as an uninsured driver, and it applies to a cyclist who was not in a car at the time. The policy of a household member may also respond.
Once the driver is identified, the claim expands to include the following:
- The driver’s bodily injury liability coverage applies first.
- The truck owner’s policy responds if the driver was not the owner.
- An employer’s commercial policy may apply if the driver was working at the time.
A Vero Beach, FL bicycle accident lawyer will request the declarations page for every policy in the household, since more than one may respond to the same loss.
What the Family Can Claim
A wrongful death claim covers funeral expenses, the support and services the rider provided to his household, and the mental pain and suffering of a surviving spouse and children. Bicycle accident damages in a fatal case also include the rider’s lost earnings from the date of injury to the date of death.
An e-bike accident claim follows the same path, and the motor on the bicycle does not reduce what the family can recover.
