Economic vs. Non-Economic Damages in Florida

Compensation in a Florida injury case falls into two categories that are proven in entirely different ways. One is a matter of arithmetic. The other requires persuading someone that a life changed.

Economic Damages

Economic damages cover financial losses with a documented dollar value. They are the foundation of most claims because they can be verified.

• Medical expenses. Emergency treatment, hospitalization, surgery, imaging, therapy, medication, and assistive equipment.
• Future medical care. Projected treatment for injuries that have not resolved, supported by physician testimony.
• Lost income. Wages, salary, tips, commissions, and self-employment earnings missed during recovery.
• Diminished earning capacity. The gap between what someone could earn before the injury and what they can earn now.
• Out-of-pocket costs. Transportation to appointments, home modifications, household help, and similar expenses.
• Property damage. Vehicle repair or replacement and personal items destroyed in the accident.

Documentation carries these categories. Bills, wage statements, tax returns, and employer letters establish the numbers, and gaps in that paperwork translate directly into reductions at settlement.

How Florida Now Limits Medical Expense Proof

The 2023 tort reform package changed what juries are permitted to hear about medical bills. Under section 768.0427, Florida Statutes, evidence of past medical expenses already satisfied is limited to the amount actually paid rather than the amount originally billed.

That distinction matters. A hospital may bill $80,000 for treatment that insurance settles for $22,000, and the second figure is now what the jury sees. The statute also imposes disclosure requirements on letters of protection, the arrangement under which a provider treats an injured person in exchange for payment from an eventual settlement, and permits inquiry into referral relationships between law firms and treating providers.

Non-Economic Damages

Non-economic damages compensate harm that never appears on an invoice. Physical pain, emotional distress, loss of enjoyment of life, disfigurement, and the strain an injury places on a marriage all belong here.

No formula governs these figures in Florida, and the multiplier approach that circulates online is not law. What actually moves the number is the severity and permanence of the injury, the credibility of the person describing it, and the specificity of the evidence. How those factors interact is addressed under pain and suffering.

Florida’s no-fault system restricts access to this category entirely in vehicle cases. Recovering non-economic damages from an at-fault driver requires meeting a statutory threshold involving permanent injury, significant loss of an important bodily function, permanent scarring, or death, which is why documentation of permanence carries such weight in car accident claims.

What Shared Fault Does to Both Categories

Fault reduces economic and non-economic damages alike. Under Florida’s comparative fault rule, a verdict is cut by the percentage assigned to the injured person, and anyone found more than half responsible recovers nothing in either category.

Caps apply in narrower circumstances. Claims against government entities are limited to $200,000 per person and $300,000 per incident regardless of actual harm, which is often the controlling constraint in a catastrophic injury case involving a public agency.

Punitive Damages

Punitive damages are a separate category with a different purpose. They punish conduct rather than compensate loss, and Florida permits them only on a showing of intentional misconduct or gross negligence, subject to a pretrial evidentiary showing before the claim can even be pleaded.

They appear rarely. Drunk driving cases and claims involving a company that knowingly ignored a known danger are the most common contexts. Most injury claims, including serious ones, involve ordinary carelessness that does not meet the standard.

Damages in a Wrongful Death Claim

Fatal cases follow their own statutory scheme. Recoverable losses include the value of lost support and services, funeral expenses, and the survivors’ loss of companionship, with different categories available to a spouse, a child, and a parent. Claims brought under the wrongful death act must be filed by the personal representative of the estate rather than by family members individually, which adds a probate step before the injury claim can proceed.
