Most injury claims settle without a lawsuit ever being filed. Filing still matters, because the possibility of trial is what gives a demand weight. An insurer that knows a case will never see a courtroom has no reason to move.
Which Court Hears Your Case
Florida divides civil jurisdiction by the amount in dispute under section 34.01, Florida Statutes.
- Small claims, for disputes up to $8,000, using simplified procedures where people frequently appear without counsel.
- County court, for amounts above $8,000 and up to $50,000.
- Circuit court, for anything exceeding $50,000.
The $50,000 threshold took effect in January 2023, raised from $30,000. Most serious injury claims land in circuit court, where the procedural rules are more demanding and the timeline longer.
The Circuits Serving This Region
Florida operates twenty judicial circuits. Two cover the Treasure Coast and Space Coast.
The Nineteenth Judicial Circuit covers Indian River, St. Lucie, Martin, and Okeechobee counties, with courthouses in Vero Beach, Fort Pierce, Stuart, and Okeechobee. The Eighteenth Judicial Circuit covers Brevard and Seminole counties, serving Melbourne, Palm Bay, and Titusville.
Venue generally lies where the crash occurred or where the defendant resides. A collision on I-95 in Indian River County proceeds in the Nineteenth Circuit even if everyone involved lives elsewhere. Local practice varies enough between circuits that familiarity with the assigned court affects scheduling and mediation, which matters for injury claims filed in Brevard County as much as those filed closer to home.
What Filing Actually Involves
A lawsuit begins with a complaint stating the facts, the legal basis for the claim, and the relief sought. Filing fees are paid to the clerk, and the defendant must then be served with process.
Service can be the first obstacle. A defendant who has moved, cannot be located, or is avoiding service delays everything, and Florida requires service within a set period after filing. The defendant then answers, raises defenses, and may assert claims against other parties, which is often where additional defendants enter a case and reshape the liability picture.
Discovery
Discovery occupies most of the time between filing and trial. Each side obtains information from the other through several tools.
Written interrogatories require answers under oath. Requests for production compel documents, including medical records, employment files, and in a truck accident case, driver logs and maintenance histories. Depositions place witnesses under oath before a court reporter, and the plaintiff’s deposition is usually the single most consequential day before trial. Physicians and reconstruction specialists are disclosed and deposed as the case develops.
Defense medical examinations occur here as well. The physician is chosen and paid by the defense, and the resulting report reliably identifies less injury than the treating doctors found.
Mediation
Florida courts require mediation in most civil cases before trial. Both sides appear with a neutral mediator, usually a lawyer or retired judge, who moves between rooms working toward a resolution.
A substantial share of injury cases resolve at mediation, for reasons that have little to do with either side’s confidence. By that point discovery is complete, both sides have seen the evidence, and the remaining question is what a jury would do with it. Nothing said in mediation is admissible if the case does not settle.
Trial
Cases that reach trial follow a familiar sequence: jury selection, opening statements, the plaintiff’s evidence, the defense case, closing arguments, and deliberation.
Two Florida rules shape the outcome directly. The jury apportions fault among everyone involved, and under the comparative fault standard a plaintiff assigned more than 50 percent recovers nothing. Separately, in a vehicle case the jury must find permanent injury before awarding anything for pain and suffering.
A verdict is not necessarily the end. Post-trial motions and appeals can extend a case well past the courtroom.
The Deadline Behind All of It
None of this happens without a timely filing. Florida’s statute of limitations for most negligence claims is now two years, shortened from four in 2023, and claims against government entities carry separate notice requirements that must be satisfied first.
