Liability is the legal answer to a simple question: who pays. The person who caused an accident is not always the only one responsible, and identifying every party who shares that responsibility often determines whether a claim is worth pursuing at all.
Liability Is Not the Same as Fault
Fault describes conduct. Liability describes a legal obligation to compensate. The two usually overlap, but not always, and the gap between them is where many claims are won or lost.
A distracted driver is at fault for a rear-end collision. If that driver was making deliveries for a company at the time, the employer may be liable alongside them. If the vehicle belonged to someone else entirely, Florida’s dangerous instrumentality doctrine may reach the owner as well. None of those additional parties did anything careless behind the wheel, yet each may owe compensation. Establishing negligence proves what happened. Establishing liability determines who answers for it.
Identifying Every Responsible Party
Serious injuries routinely exceed a single driver’s policy limits, which makes the search for additional defendants a practical necessity rather than an aggressive tactic.
- Vehicle owners. Someone who entrusts a car to another driver can be responsible for the harm that driver causes, even when the owner was nowhere near the crash.
- Employers. A company answers for the negligence of employees acting within the scope of their work, and may face separate exposure for hiring or supervision failures.
- Commercial carriers. Trucking companies, their brokers, and sometimes the shipper can each bear responsibility depending on how the load and the driver were managed.
- Property owners and tenants. Both may owe duties to people injured on the premises, and lease terms often determine which one.
- Bars and vendors. Florida limits this exposure narrowly, but service to a minor or to a person known to be habitually addicted to alcohol can create liability under state law.
The parties named early shape everything that follows. Adding a defendant after discovery closes is difficult, and the statutory filing deadline leaves less room to correct that mistake than it once did.
Employer Liability and Commercial Vehicles
When a crash involves a vehicle operated for business, the investigation widens considerably. A truck accident claim examines driver qualification files, hours-of-service logs, maintenance histories, and the carrier’s own safety record, because a company that put an unqualified or exhausted driver on the road faces exposure independent of what the driver did.
Rideshare collisions follow a different structure. Coverage under section 627.748, Florida Statutes shifts depending on whether the app was off, the driver was waiting for a request, or a passenger was in the car. Two crashes minutes apart can fall under entirely different policy limits, which is why rideshare claims turn heavily on app data.
Property Owner Liability
Owners and occupiers owe duties that vary with why a person was on the land. Business visitors receive the most protection, and under section 768.0755, Florida Statutes, someone injured by a substance on the floor must prove the business knew or should have known the hazard existed.
That knowledge requirement is the central battleground in most premises liability cases. Inspection logs, cleaning schedules, and prior incident reports often decide them. Animal attacks work differently, since Florida imposes strict liability on owners in dog bite cases without requiring proof of prior aggression.
When a Government Entity Is Responsible
Claims against a city, county, or state agency proceed under section 768.28, Florida Statutes. Written notice must go to the responsible agency and to the Department of Financial Services within three years, and suit cannot begin until the agency has had 180 days to investigate. Recovery is capped at $200,000 per person and $300,000 per incident.
Those caps change the calculus in catastrophic cases. When the harm far exceeds what the statute allows, identifying a private contractor or co-defendant who falls outside the cap may be the only path to meaningful compensation.
How Shared Responsibility Divides the Bill
Once liable parties are identified, fault gets apportioned among them and among the injured person. Under Florida’s comparative fault rule, each defendant pays according to its own percentage rather than jointly, and a plaintiff assigned more than half the blame recovers nothing.
Defendants use that structure strategically, pointing at absent parties to dilute their own share. Countering it requires evidence about each party’s actual role, which is one reason the scope of damages and the allocation of responsibility get litigated together rather than in sequence.
