Nearly every injury claim in Florida turns on negligence. The word carries a specific legal meaning, and proving it requires more than showing that someone made a mistake and you got hurt.
What Negligence Means Under Florida Law
Negligence is the failure to act with the care a reasonably careful person would use in the same situation. It does not require bad intent. A driver who glances at a text message, a store manager who leaves a spill unattended, and a property owner who ignores a broken stair rail have all fallen short of that standard, even though none of them meant to hurt anyone.
The reasonable person standard is deliberately flexible. What counts as reasonable care on a quiet residential street differs from what it requires on I-95 during a downpour. Juries decide where that line sits based on the circumstances in front of them.
The Four Elements of a Negligence Claim
To recover compensation, an injured person must prove all four of the following. If any one fails, the claim fails with it.
- Duty. The defendant owed you a legal obligation to act with reasonable care. Drivers owe this duty to everyone else on the road. Businesses owe it to customers who come onto the property.
- Breach. The defendant fell short of that obligation through something they did or something they failed to do.
- Causation. The breach actually produced your injury, and the injury was a foreseeable result of that conduct.
- Damages. You suffered real, measurable harm. Medical bills, lost income, and physical pain all qualify. A close call that hurt nobody does not.
Assigning liability becomes more complicated when several parties contributed to the same accident, since each one’s share must be established separately.
How Duty of Care Shifts by Situation
The duty owed depends on the relationship between the parties. Commercial drivers are held to standards set by federal regulation, which is why a truck accident claim examines hours-of-service logs and maintenance records that would never come up in a two-car collision.
Property owners face their own rules. Under section 768.0755, Florida Statutes, someone who slips on a substance in a business must prove the business knew or should have known the hazard was there. That knowledge requirement makes a slip and fall claim harder to prove than most people expect.
Some claims skip the negligence analysis entirely. Florida applies strict liability to dog bite cases, meaning an owner can be responsible whether or not the animal had ever shown aggression before.
Proving Breach and Causation
Breach is often the easier element. A citation, a red light camera, or a witness who saw the other driver looking down can establish it quickly. Causation is where claims tend to break down, particularly when the defense argues that your pain comes from a condition that predated the crash.
Medical records created close in time to the accident carry the most weight, which is why gaps in treatment become such a problem later. Vehicle data, surveillance footage, and scene conditions all have short shelf lives, so preserving evidence in the first days after a crash often determines what can be proven months later.
How Shared Fault Affects a Negligence Claim
Florida no longer allows recovery to everyone regardless of blame. Under section 768.81, Florida Statutes, anyone found more than 50 percent responsible for their own injuries recovers nothing at all. Below that line, compensation is reduced by the percentage assigned to you.
Insurers understand this arithmetic well and work to push your share upward. How those percentages get argued, and what evidence moves them, is covered under comparative fault. Timing matters just as much, since the deadline to file most negligence claims in Florida is now two years.
Negligence Claims Against Government Entities
A crash caused by a city truck or a fall on county property follows a different track. Florida waives sovereign immunity only within the limits set by section 768.28, Florida Statutes, which caps recovery and requires written notice to the agency before any lawsuit is filed. Missing that notice step ends the claim regardless of how clear the negligence was.
